Fair Hearing and Aid Continuance are not automatically given.
If a fair hearing is needed due to reduction of hours or discontinuance, applicant has 60 days from notice date to request a fair hearing.
When an applicant requests/files for a fair hearing they need to stress “aid continuing”. Otherwise, the applicant loses their home care services until the fair hearing decision.
Aid Continuing is generally granted for those who filed for fair hearing within 10 days of the Notice date.
